Terms of sale and licence
1. Who sells
TradeRecall is sold by Stjepan Mikulić, a private individual in Croatia (the “seller”). Contact: support at traderecall.app. Full seller details: Seller.
2. What you buy
A one-time, non-expiring licence to use TradeRecall version 1 (“V1”) on up to 2 computers at the same time, with every V1 update released. A later major version (V2) is a separate product and a separate purchase; it is not part of this licence.
3. Trial
TradeRecall can be used with every feature for 30 days without payment. After the trial the automatic features stop; your data, the manual journal and manual import keep working. Nothing you recorded is deleted or withheld.
4. Price and payment
The price is shown on the pricing page and at checkout. Payment is handled by Stripe; the seller never receives your card details. Prices are in US dollars. The seller is not registered for VAT, so no VAT is added.
5. Activation
The licence is activated in the app with a licence key. The app checks the licence with the licence server now and then and keeps working offline in between. The licence server stores your email, your purchase and the names of the computers the licence is activated on — never any journal data (Privacy).
6. What the licence allows
You may install and use TradeRecall for your own trading journal. You may not rent the licence, share the licence key with other people, or remove the licence check.
You may pass the licence on to another person, for example by selling it. Write to support at traderecall.app from the email the licence was bought with and give the new owner’s email. The seller deactivates the licence on your computers and moves it to the new owner, who then uses it under these terms. The licence moves as a whole and cannot be split between people. Moving it costs nothing. Your journal stays on your computers; it does not go with the licence.
7. Refunds
See the refund policy. A refunded licence is deactivated.
8. Not trading advice
TradeRecall records and shows your own trading. It never tells you what to trade, and nothing in it is financial advice. Trading involves risk of loss.
9. Liability
The seller is liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever the law does not allow liability to be limited.
For ordinary negligence, the seller is liable only for breaching an obligation that is essential to the contract, and only for the damage that is typical and foreseeable for this kind of contract, up to the price you paid for the licence. For lost data, the seller is liable only for what restoring it from a regular backup would have taken.
Within these limits, the seller is not liable for trading losses, lost profits or decisions you make based on what TradeRecall shows. TradeRecall records your trading; it does not place, change or cancel orders.
Your statutory rights as a consumer, including your rights when digital content does not work as agreed, are not affected. Beyond them, the seller gives no additional guarantee.
10. Law and disputes
These terms and every purchase are governed by Croatian law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. If you are a consumer, you keep the protection of the mandatory law of the country where you live, where it gives you more.
If you are a consumer in the EU, the courts of the country where you live are competent. In every other case, the competent court in Zagreb, Croatia is.
If something goes wrong, write to support at traderecall.app first. The seller does not take part in proceedings before a consumer dispute resolution body. In a dispute with a seller in another EU country, consumers can also turn to the European Consumer Centre of their country.
